O Tribunal Pleno declarou a inconstitucionalidade de trechos da lei estadual n.º 3.498/2010, na parte que trata de critérios de desempate em concurso público para ingresso na Polícia Militar e no Corpo de Bombeiros Militar do Estado do Amazonas (artigo 15, incisos II a V), com efeitos a partir do trânsito em julgado do acórdão.
A decisão foi por unanimidade, na sessão da última terça-feira (16/9), na Ação Direta de Inconstitucionalidade (ADI) n.º 4005593-51.2023.8.04.0000, de relatoria da desembargadora Lia Maria Guedes de Freitas.
Segundo a magistrada, “os critérios de desempate estabelecidos pela referida norma afrontam os princípios da isonomia e razoabilidade, ao permitirem, sob a justificativa de privilegiar candidatos mais experientes, seja dado tratamento desigual àqueles que muito embora não sejam militares ou oriundos da administração pública estadual, possuem experiência na administração pública federal, municipal ou na iniciativa privada.”, conforme trecho do voto.
Tais critérios caracterizam ofensa ao artigo 19, inciso III, da Constituição da República, de acordo com a relatora.
Efeitos
A modulação dos efeitos da decisão se justifica para preservar a segurança jurídica e os efeitos dos concursos públicos já realizados com base na lei questionada, especialmente os Editais n.º 01/2021-PMAM e n.º 01/2021-CBMAM. Isso porque durante os mais de 10 anos de vigência da norma impugnada houve a publicação dos editais para provimento de cargos por meio de concurso público, regidos pelos referidos dispositivos legais.
“A fim de preservar a segurança jurídica e o ato jurídico perfeito, especialmente no que diz respeitos àqueles que se submeteram aos referidos certames, tendo sido aprovados e nomeados, julgo por necessário modular os efeitos da presente declaração de inconstitucionalidade, para que tenha eficácia apenas a partir de seu trânsito em julgado”, afirma a relatora em seu voto.
Quanto ao pedido declaratório de inconstitucionalidade do artigo 25 da mesma lei, este foi extinto, pois tal artigo já havia sido declarado inconstitucional no julgamento do processo n.º 2011.004793-0/0004.00, que transitou em julgado em 13/01/2017.

“Art. 15. Em caso de empate e desempate em concurso, a classificação será deferida na seguinte ordem de prioridade, de tal forma que os mais próximos excluem os mais remotos:
II – aos militares da PMAM ou CBMAM;
III – aos militares de outras Instituições;
IV – aos servidores públicos do Estado; e
V – aos servidores públicos de outros entes da Federação.
