Decisão do 18.º Juizado Especial Cível da Comarca de Manaus, julgou procedente a ação ajuizada por um consumidor contra operadora de telefonia, condenando a empresa ao pagamento de indenização no valor de R$ 5 mil, a título de danos morais, e danos materiais de R$ 238,32, em dobro. Além disso, a sentença determina o cancelamento de cobranças indevidas relacionadas a serviços digitais não contratados pelo requerente.
Na sentença, o juiz reforça o dever das operadoras de garantir transparência nas cobranças e resguardar os direitos dos consumidores, sob pena de responsabilização judicial, conforme prevê a legislação vigente.
A decisão teve como base o Código de Defesa do Consumidor (Lei n.º 8.078/1990), a Lei Geral de Telecomunicações (Lei n.º 9.472/1997), o Código Civil (Lei n.º 10.406/2002) e a Lei Estadual do Amazonas n.º 4.712/2018.
A sentença destacou, ainda, que os SVA, como aplicativos digitais ofertados pelas operadoras, não integram o serviço essencial de telecomunicação. A classificação está prevista no artigo 61 da Lei Geral de Telecomunicações (Lei n.º 9.472/97), que define os SVA como atividades distintas do serviço de telecomunicações, exigindo consentimento expresso do consumidor para sua contratação.
Em seu entendimento, o magistrado observou que a operadora não comprovou a autorização do consumidor para a cobrança desses serviços, incorrendo, assim, na prática abusiva prevista no artigo 39, inciso III, do CDC, que veda o fornecimento de produtos ou serviços sem solicitação prévia do consumidor.
A alegação de gratuidade dos SVA/aplicativos digitais, apresentada pela operadora, também foi afastada pelo magistrado, tendo em vista que o total de descontos aplicados aos mesmos não é repassado integralmente ao consumidor conforme demonstrado nas faturas constante dos autos.
O juiz também invocou o artigo 1.º da Lei Estadual n.º 4.712/2018, que proíbe a cobrança, em faturas de serviços públicos e privados, de produtos ou serviços alheios ao fornecimento principal ou que induzam o consumidor a erro. Segundo o magistrado, a inclusão dos SVA na fatura de telefonia sem contratação expressa violou essa norma estadual.
Por fim, a restituição em dobro dos valores pagos indevidamente foi amparada no artigo 42, parágrafo único, do CDC, e a indenização por dano moral foi arbitrada conforme os critérios do artigo 944 do Código Civil, considerando o grau de culpa da ré, as circunstâncias do caso e a extensão do dano.
Em sua narrativa, na petição inicial, o consumidor afirmou estar pagando valores de serviços pelos aplicativos “Claro Banca” e “Skeelo Ebook”, adicionados sem autorização expressa,
A petição também destacou que a prática relatada não seria um caso isolado, mas parte de um modus operandi empresarial reiterado, com potencial de atingir inúmeros consumidores. O autor solicitou, ainda, a concessão da justiça gratuita e tutela antecipada para suspensão imediata das cobranças futuras.
Além do ressarcimento financeiro, o autor alegou ter sofrido abalo moral diante da repetição da cobrança não autorizada, da perda de tempo com tentativas de resolução extrajudicial e da frustração decorrente da conduta da empresa.
A empresa de telefonia contestou a ação e negou cobranças indevidas de serviços digitais e alegou que os aplicativos questionados pelo consumidor fazem parte do pacote contratado de forma legítima, e que não houve qualquer cobrança adicional indevida.
Segundo a contestação, os valores apontados pelo autor estão discriminados na fatura apenas para fins fiscais e de transparência, não representando acréscimos ao valor total do plano. A empresa argumentou ainda que não há venda casada, pois os serviços fazem parte da estrutura do plano ofertado ao cliente no momento da contratação.
A empresa também contestou a existência de qualquer prática abusiva ou ilegal, refutando a acusação de que os serviços foram incluídos sem consentimento do consumidor.
Da Sentença ainda cabe recurso.
