O Supremo Tribunal Federal (STF) marcou para a próxima quarta-feira (1°) o início do julgamento sobre o reconhecimento de vínculo empregatício entre entregadores e motoristas de aplicativos e as plataformas digitais. A controvérsia é conhecida como uberização das relações de trabalho.
A decisão a ser tomada pela Corte terá impacto em 10 mil processos que estão parados em todo o país à espera do posicionamento do plenário.
Serão julgadas duas ações que são relatadas pelos ministros Edson Fachin e Alexandre de Moraes e chegaram ao Supremo a partir de recursos protocolados pelas plataformas Rappi e Uber.
Contestação
As empresas contestam decisões da Justiça do Trabalho que reconheceram o vínculo empregatício com os motoristas e entregadores.
A Rappi alegou que as decisões trabalhistas que reconheceram o vínculo de emprego com a empresa desrespeitaram posição da própria Corte que entende não haver relação de emprego formal com os entregadores.
A Uber sustentou que é uma empresa de tecnologia, e não do ramo de transportes, e que o reconhecimento de vínculo trabalhista altera a finalidade do negócio da plataforma, violando o princípio constitucional da livre iniciativa de atividade econômica.
Além das defesas das plataformas, os ministros vão ouvir durante o julgamento as sustentações orais de entidades que defendem o reconhecimento do vínculo trabalhista de motoristas e entregadores.
O julgamento sobre a uberização será a primeira pauta do plenário sob o comando do ministro Edson Fachin, que será empossado no cargo de presidente do STF na próxima segunda-feira (29). Ele sucederá o ministro Luís Roberto Barroso, que encerrará mandato de dois anos à frente do tribunal.
